Not to put any dampers here, but this is extremely frustrating for the EB3 India folks. I mean how freakin long do WE have to wait before we get our turn!
Nothing against EB2 or other, at least let them enjoy the freedom.
It is really frustrating, because of the mistake by the attorney or stupid company policy etc, people like us with pd 2001 etc waiting on EB3. In my case I had PG with 7 yrs exp when filing, but for the stupid lawyer and company policy. putting aside the original classification of categories, given the present scenario, Not sure what way EB2 is better than EB3

Maintaining GC is a big hassle you have to return every year (2years for the first time i think). Couple of Infosys blokes (with GC) that i know had discussed this with the company before joining and the company sent them within 2years on a short term projects to the US.
If you have a US citizenship then you can opt for a dual citizenship. That might help you get a job directly in India (dont know the rules, just guessing)

When I came to the US 6 years ago, I had deliberately made the decision not to decide in the first couple of years about staying on or returning back after sometime. Marriage, kids, school, house, GC...Citizenship...it kinds of gets on you. And before you know, your kids are making the decision for you. I know of a couple of families with grown up kids who moved back to India only to move back to US because the "kids could not adjust". It's not hard to read between the lines that "we also could not adjust".
As days go by, it is becoming more clear everyday that I will also return back one day, sooner rather than later. I have some questions that haunt me:
- if/when I get my GC, and if I return back, is there a way to hold on to the GC status?
- if someone has a US citizenship, when companies such as Infosys hire them, do they have to get a work visa or something? Is there a concept equivalent of H1/GC for non Indians yet?

I think there are many ways to look at it. Doing Free service , yes it is a form of Gandhigiri, but will that cause the lawmakers to recognize us and pass laws in favor o fus..I do not think so.
I think our situation is no different than people in South Africa in Gandhian times. How Gandhi fought for them is by writing and writing and pestering the Authorities to reduce unfair taxes on Indians in SA and to solve other problems they had like cannot ride in the same Trains/cars as Whites etc...., fighting for their rights in a Vocal but Non Voilent - non aggressive approach.

My stand is based on the premise that a man is financially responsible for his wife and his kids and not to wife's parents! The point I was making is about a completely non working spouse. It is not about a wife that leaves workforce for medical reason temporarily.

I think u r right. We shouldn't think abt our future in this country and nor abt the people who were in backlog as we r the one's who suffered the most.Y we have to suffer because of mis-communication between DOS n USCIS.If they will be taking our reaction in negative way let them. If they want to revive CIR(Legal immigration-point system) , let them do. If they do, the same as British did , let them. Let see our present, don't worry about future.If they think to throw us back to our home country ,the right they have , let them do. But i just want to say is that- if they made an inquiry over this issue,not only they'll hold all backlog cases that r approved now but also they will stop issuing new visa numbers till this is resolved-result -delaying the process more. It will definetely take time. The thing is atleast backlog is cleared now, so the process will move smoothly.But anyway lets fight for injustice done to us.Lets don't wait for oct opening.We want now!!!

So you want the people who are working on the initiatives to to go through and read and respond to every individual?
wow!
I support the donor idea. But there is no transperency to who is leading what initative. If i want to contribute my time, i have to read through the posts every day for several hours to find who is leading the effort so i can discuss with them. Sometimes i feel there is so much more talk.
Why don't we list out the initiatives that is being considered or worked on. Along with some contact information so people can discuss offline with them. I cannot be online for several hours and read through all the discussions and still not find out who is coordinating the efforts.

C�mon boy I�m not asking to make Steve miller their VP operation and use that million dollar in grants to fund that project. What I�m asking is �can you tell us how many applications you received of which chargeability and in which EB categories� and assurance that they will issue EADs and APs in less than 90 days. To ask this you don�t need citizen rights you are asking a public agency a service which they are supposed to provide and they are charging us to do that�

This is aboslutly not possible; he/she is trying to fool every one. Before retrogression, the last date to file a 485 for a EB3-Indian with PD 08/2004 was 12/31/2004. From Jan 2005 till July 2007 EB3 Inida was retrogressed for his PD. So he/she could not apply 485 in Feb 2005. The other optins could be he/she may be in EB2 catagory or a Schulde A nurse.
I was in similar time frame; So I know the date well....

I don't know if anyone of you has ever gotten on a rush hour train in mumbai. But before leaving for the US, a wise man told me that going to the US is like getting on a train in Mumbai, it's a struggle to get in. You'll have to push, shove, maybe stand on the footboard for a while. But once you get in, hold on tight until you get to your station. That's the philosophy I apply to all of this green card mess. I will hold on tight until my station comes.
My personal opinion is that the US is really not that unfair when it comes to immigrants. All the complaining that we do about unfairness, we do because we hold the US to American standards. We expect justice, effeciency, fairness that is expected of the US of A. We would not even have a chance to complain in most other countries (such as the middle-east, asia and to some extent Europe), because we would quite simply agree that we are always foreigners in those lands, no matter how long we live there, and that our rights as foreigners are limited.
Despite not having a GC, I have never felt like a foreigner here (I grew up in a bunch of countries, so I think I have a a few points of reference). I don't think having a GC will change anything. I can buy property and invest, work as I like, drive a car, speak my mind, pretty much do anything an american can.
We all seem to think GC is a magic bullet that solves all our problems. But in my observation, I have seen people languish in middling careers even after getting a GC, and I have seen people shoot up in their careers, or start successful businesses on H1B. GC might make things easier, but it certainly will not ensure success.
All of us are intelligent, enterprising risk-takers. I say risk-takers because setting up life in a new country is always fraught with risk. And we have taken that path. So we must accept all the ups and downs that come with it.
So my friends, if you're on the train, hang tight till your station comes. If you're planning to jump off mid station make sure you jump off in the direction of the train. :)

Thanks!. There were some skeptics on IV Forums who didn't believe that USCIS worked over weekend to approve 25,000 visas. :mad: Some people genuinely believed that USCIS made a clerical error in calculating visa number or some other nonsense excuse. Those who don't believe that this indeed is a scandal,should read Logiclife's excellent analysis on June 29th where he explains -how retrogression is NOT possible.

I know a Controller making 70K and got his GC via L1-A in 6 months. I make 50% more than him and got my PERM approved in EB2 2 weeks ago. Life isn't fair, take it easy.

Here is my point. I spend several hours 3-4 hours at least every day looking through the forum posts hoping to find ways i can contribute to efforts. There are several ideas that are generated in the forum. But cannot find out who is leading it. All i am saying is if we can have a listing of initiatives with some names associated. So i can contribute to the ones that i can support. I am not sure if i am asking for too much here. I am not a IT guy. I do not know what it takes to post it in the front page.
