United States Citizenship and Immigration Services (USCIS) released an updated H-1B cap count of 45,100 as of August 28, 2009. This reflects an increase of 100 cases from the prior count, provided on August 14, 2009. The advanced-degree cap remains at 20,000. The USCIS continues to accept FY2010 H1B cases under the advanced-degree and regular caps.
We suggest to US employers to file H-1B Petitions only if they can able to provide the Client details like Letter from the end-client, Work-orders confirming the placement. If you are having an in-house requirement, provide USCIS with ample proof of your in-house requirements. Considering the flood of H-1B RFEs, we have to be bit cautious in filing works. The standard approach prevailing until last year needs a re-look. Be assured, if you are right on papers and abide the Immigration requirement, you will for sure come with flying colors. We will be happy to help and support you in H-1B and other filings. It is widely believed that the H-1B Cap will be available even after Sept. 30, 2009.

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?
Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....

Hi, Last year, I heard about a new rule that says that H4 time will not be counted against H1 time so basically, if someone is transferring from H4 to H1, the time spent in H4 will be excluded while deciding the duration of H1.
Is this rule true ? I mean, has it become a law now ? Did somebody use this rule to grab the time spent in H4.
Please let me know.

I posted this message earlier in some other thread. Actually my questions were irrelevant to the thread I added the message on. Hence, creating a new thread.
I have couple of questions regarding GC filing for future employment.
a. Is it legal to work for company B if one is working for company A and company A has already filed LC?
b. Any danger of getting audit because of multiple LCs?

USCIS has announced that beginning October 1, 2010, domestic offices and U.S. territories, including the U.S. Virgin Islands and Guam, will no longer be accepting cash payments. Other payment options will include money orders, credit cards, and checks (including personal checks).

This story really makes me happy. I just wrapped up a dozen years of service on the board of the Hebrew Immigrant Aid Society, the organization that helped my family and my wife's family immigrate to the US. My friend approved PERM in EB2 have qualification 3 year B.SC + 1 Year B.Ed + 2 year MSc. total 6 years of college, filed I-140 and was denied because of education. The labor is for Masters with 0-1 year experience. But they want 4 year degree prior to masters, citing EDGE database. Now the appeal is with AAO.
My question:
1. Do he can apply with the same labor for EB3 ?. What is the chance with two I-140 with same labor ?
( He filed I-140 for EB2 with that labor before 6 months of PERM certification. The PERM certified on April 2009 )
2. Or he need to do a fresh PERM with EB3 as a backup till the AAO verdict ? (takes 22 months)
