My 7th year H1-B renewal was mailed by my lawyer on March 30th to the Vermont Serice Center. They received it on March 31st. I know that there was a change in filing taking effect April 1st. What happened in my case is that the USCIS forwarded my files to the California Service Center without receipting it first. California reveiced my file on April 4th and now I find myself out of status. My lawyer tries to tell me that it was an USCIS mistake whereas a lawyers who I retained for a second opinion tells me it was the mistake of the first attorney. I did everything possible for the to reconsider their decision but I still would like to know who's to blame. If it was indeed the lawyera mistake I'm considering filing a complaint against him.

I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.
That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.

My employer (desi consultant) had asked me to send an Application for Unpaid leave so that he can maintain my H1b status. I sent a vacation letter for 2 Weeks and for which he has not paid me a bench salary. Now again he is asking me to submit another letter of unpaid vacation until the date I will get my next project.
My dilemma is how long should I entertain such requests from him and if in case I refuse to go on vacation what are my chances of being laid-off?
Will Employer loose any of his eligibility like no new H1/GC petition for short future up on lay off?

Hello - I just recd. the TRANSFER NOTICE for me & my wife's 485 case stating that the case has been transferred to USCIS-NBC, PO Box 648005, Lee's Summit, MO 64064. We had filed for AOS in July 2007 and my priority date for is April 2006 (EB-2).
I would appreciate it if somebody can please shed some light on what this means for us. What are the implications for us.? Will the case be transferred to the local office.? Should i start to gather documents for a interview.

Hi, my BIL was on H1, and lost his job, then he moved on to EAD, which he hadnt because my sister was on h4, then my sister got a job and went to home country to get it stamped as advised by their lawyer. Now her visa got rejected, maybe bec the company she got the job in is not very big. Anyway now for her to come back, my BIL has been advised to go back on H1.
My questions are:
1) How safe is it to go from EAD to H1
2) Is it true that if you are on EAD and then if you try to go back to H1 the chances of it getting rejected are high? And if your H1 gets rejected then there are chances that your EAD will also get rejected?
3) How long does it take to move from EAD to H1
Any insights/suggestions/advises on the above would be greatly appreciated.

It depends. It may become 'U" but if your application is already 'pre-allocated a visa' during June, then you may still get some news in July.
But I do believe it will not become 'U' in July. Maybe in August and September it will become 'U'.

Well need some help. I moved from H1-B to F1 visa to do masters. Now I want to quit F1 in middle and go back to doing H1-B and continue masters part time.
I know there are still slots open for H1-B for 2010. Please correct me if I am wrong.
Now I can do summer internship untill August 26, the question is, how can I work for the employer for the month of September? since H1B starts on Oct 1st. I can do CPT full time but, then again I heard you can not quit CPT in middle of the semester.
Any suggestions will be greatly appreciated.

Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I do have the copy of my I-140

I may get a better offer. My question is
1. Since I have a new H1b which is valid for 3 years (for H1b year 7,8 and 9), can I transfer it to a new employer?
2. Also, the new employer is willing to file GC, can I use my old PD date. (the new job profile is similar)
3. If the current employer withdraws my I-140, will that affect my H1 transfer?
Please help.

How about we bring the 2 worlds together. We have a Menu Item on the Left saying either "FAQ's about immigration" or "Q/A from lawyers" etc. and somewhere on the homepage plus in the forums section we put some text saying "Before posting please check out the answers from lawyers" and put a link to the same.
Along with that (if possible), we also put all the questions and how many have been answered and which ones are going to be answered.

Can labor and I140 be filed from an employer, even if employee is not working for that employer currently, may be with the intention of joining that employer at later date? Please reply.

Yes. GC processing is for a future job. So, labor and I-140 can certainly be filed without being on the payroll. I think I-485 also can be filed before joining the firm. But you should confirm this part from a lawyer.
