�A key part of the American economy is our ability to innovate. Yet, today, our country�s technology companies are facing an impending crisis which requires critical interim relief,� U.S. Sen. Cornyn said today. �USCIS�s announcement this year that the cap for H-1B workers was met in just one day, coupled with the recent July announcement that employment-based visas were no longer available for those with advanced degrees, makes clear that industry needs interim relief today until we can return to comprehensive immigration reform. This amendment will go a long way to help out businesses that are the life-blood of the U.S. economy and I hope my colleagues will join me in supporting it.�
Specifically, the Cornyn Amendment would allow the Department of State and DHS to �recapture� unused employment-based visas. This is not an increase in employment-based numbers but rather, a direction for the agencies to use all the visa numbers that are available today. These visa numbers will be distributed to nurses and physical therapists and aliens with extraordinary ability, advanced degrees, and needed skills. In addition, the Cornyn Amendment also includes a one-time H-1B increase of 115,000 (up from the 65,000) for FY 2008 only.
So maybe the H-1B provision killed it??

The numbers are assumptions and NOT facts. Most of these numbers have actually been pulled from other places or based on some rationale (for example 750,000 from Matthew Oh site, 5 minutes/EAD based on what need to be done to print out a card and pack in an envelop)
Workforce of 30 though is a gross assumption. Bigger the number better it is. So we may actually want to question USCIS if there are any resource constraints.
Outsourcing is a perfect Idea! What do you have in mind Wipro at Banglore? :D
What about bringing on H1B fresh graduates as Visa Processing Experts with a two days of Boot Camp Training? Anyway, we are forgetting that USCIS processed 25000 applications in 2 days. Please do not undermine efficiency we have seen in last days -- with that rate, I expect everything to get cleared in few weeks. If improved productivity is maintained/sustained to this level, I do not see any chance for outsourcing or bring H1B guys to this country. Best luck America!

I do not believe the 800,000 figure for I-485 alone. It could be a misquote from Aytes. The 800,000 is possibly combination of all immigration related applications such as I-140, 485, 131, 765, etc.
Even during last year when EBs are current, it didn't reach that many applications. I believe Matthew OH is more accurate in saying there's a total of 320,000 I-485 applications.
With that figure, average 2.5 years waiting is in order. But that should not be distributed equally among all countries due to per country limit. I would guess, for India and China, it would be 3 years wait, and for the rest, 2 years.

I called USCIS customer service to ask for the attorney name on file and they said that they didn't have access to that information and I would have to get an Infopass appointment for that. Given the crap that ChanduV had to deal with (for changing jobs on AC21) during his infopass appointment, it is probably best I just wait to ask that question until my second biometric appointment is due in a few months.

Well - not every officer will deal with you in the same manner. It was my bad luck. I am sure, I might find someone helpful if I go again. So don't get intimidated and discouraged.

See what I was saying. They are not supposed to grant CP appointments and approvals in July per the regulations. They have decided to bend the rules to approve the currently pending 485s and CPs. They came up with this lame excuse that since the visas were already shipped out to the consular posts ................yada yada. Point is as I said they can't do 18K CP applicatrions in a day at the consulates the way they seem to have done for the 485s. Even this I am not sure.
I doubt whether they have sent out all 60K 485 approvals either, they probably will in the course of the next month or thereabouts.
I'll say it again, they want 485s out but they don't want them in for whatever reason. It is getting clearer.

Do all agree that "bridge bill" is the only real helpful measure for us? Or you can show us some other ways?
I mean let's set at least one goal!
After that we can establish what we have, and how we can make it real.
Anyway, it might be quite difficult to organise such a work group, because the majourity of schedule A are outside the US, and on CP... But we all have our emploiers and attorneis who could help us to lobby our interests in the US.
What do you think about it?
My wife is a RN just passed her NCLEX from Texas. She studied in US. Looking for a sponsor. Asked one of them and they replied there is no H1 for Nurses, you have to be a BSN to be sponsored. Time is bad for nurses after Schedule A quota is over.

guys i think USCIS is not interested in giving EB 3 guys GC...
as mostly EB 3 guys r ppl with Bachelors (and less than 5 yrs exp) or who are stuck with EB3 due to there company (like me)...
EB 2 guys r mostly with ppl having masters degree from US...so i guess they will definetly get more preference than eb3...
I guess US wants to raise there economy by giving GCs...so that ppl more ppl will buy houses....
I hope something happens for EB3 also...but I guess in Oct bulletin PD for EB3 will b some month in 2001....

As latest Visa bulleting states - DOS people had predicted and planned - They will move EB3 dates forward to cover all June applicants - that means moving cut-off dates for EB3 - India to Jun 2003 as per Jun 2007 bulletin. For some reason - they see heavey demand now and it may not be the case in next bulletin. Still they beleive its diffcult to predict any dates for EB3 before mid Sept. They are working and intention are there to help EB3 applicants. That leads to make me believe that dates for EB3 - India would move to somewhere Nov-Dec 2002 to Jan-Feb 2003 in next bulletin.

I have just talked local Congresswoman's Office and I have talked to a staff member for 1 hour and she is helping me. She is going to call NSC and get to the root cause of this problem.
