Do not generalise all consulting companies...At least people working in these consulting companies sponsored GC and buying house and spending their money here. Most of the fradulent GC process was done by these croocked indian companies. They exploited the EB1C system to the maximum extend. Most of the times, they are not filing the GC and keep the employees as slaves or they exploit the EB1c fo their boot lickers.
Does anyone know such a bootlicker getting EB1c based GC? I wonder what a smart aleck that guy must been. There was a piece on NYT about India's penchant with lines and cutting lines by the uppity mongers..:D

Its very interesting reading everyone's stories. To me GC represents freedom. Freedom to work for whom you want to, in a field you want to, not to work for someone you don't want to. To start your own buisness, to do all those things which US is known for. This country encourages entrepreneurs and I would like to be one, one of these days :).

I am not sure why people jump onto drawing conclusions so fast...look at the above post from a so called professor....he encountered a couple of a folks from some universities & concludes that those universities are just crappy....!! Many of my colleagues are from the professors' "oh-so-good" list of IITs/univs and they are no better!! (In fact, some of them suck so bad)!!

Now another question for you prof....how come are you working in a university that's giving admissions to such a bunch of crappy folks...!!?? I do not particularly disagree with either points. AFAIK, there are many colleges under the Anna University (i.e., students from all colleges get the same degree); some of them might teach properly and students may learn something. But the point of illustration was that there got to be some serious problems with those degrees if a significant number of students are getting that degree without actually learning/knowing anything. I never made a statement that *every* Anna/Osmania Univ. student is bad. My statement is that I have witnessed a large number of singularly bad students with degrees from those Universities. Those students may well be at the bottom pile. The point is that even a bottom level student who get an engineering degree must know better than those students: otherwise they should not be given the degrees. There are not-so-good people in IITs (B.Tech) as well; I know a few personally. But even they are way better than the students I have encountered. Let me know if you have met some B.Tech (and not M.Tech) from IIT who cannot write a 'hello world' in C; I am very curious.

But that clearly illustrates the point that Wadhwa stated; there is a severe shortage of jobs that *require* a Ph.D. It is plain impossible to get a faculty position in a reasonable school in CS/EE, in particular, in computer networking. There are just no jobs. Note that my track record is quite good: Ph.D. from a good school (although not in the top ten) with a good publication list (a reasonable number of papers; all in good journals/conferences like Transaction on Networking; JSAC; INFOCOM, etc.; most of them cited many times) and a post-doc from an Ivy league school. At present, other than Biomedical Engineering and related fields, faculty positions are very scarce. And hopefully you understand that you cannot "change fields" like a computer programmer since in academia you need to have a research record of 4-5 years in the new field before you can change to it. I wanted to be in academia and struck this trade-off of accepting a position in a not-so-good school.

Here is my point. I spend several hours 3-4 hours at least every day looking through the forum posts hoping to find ways i can contribute to efforts. There are several ideas that are generated in the forum. But cannot find out who is leading it. All i am saying is if we can have a listing of initiatives with some names associated. So i can contribute to the ones that i can support. I am not sure if i am asking for too much here. I am not a IT guy. I do not know what it takes to post it in the front page.

It's call reseach topic.. We have to find some USCIS support documents for each case. We need some earlier USCIS decisions for each senarios/theories.
RG provided few supporting CIS rules in earlier post and seems logical. But not sure if RG or RK is right.
It's confusing indeed.
I went thru' both links posted above in thread.
It seems that according to RG, EAD will remain valid till the time to file appeal (MTR), once appeal is filed the applicant would be able to work. He also suggested to go on EAD to save any time remaining from initial 6 years.
According to RK, EAD will be invalidated, person is to be deported as soon as CIS denies 485 in error. He strongly suggest NOT TO GO on EAD if some one has H1 as an option.

We would request you to bring HR 5882 to the table and hence help people waiting for so long get immediate relief. We think this is the best time to do it as there are so many waiting in long queues for so long and are unable to buy houses though they are at rock bottom prices now, or change companies as some of us would also like to, and start new companies and jobs. There are very much needed in this time of economic crisis. Applicants in EB3 and EB2 Employment based greencard category are severly backlogged.
The problem is mainly due to country based quotas and wastage of many greencards due to administrative delays over the years, as you know. This can easily be fixed with a simple administrative action and need not need to be done as part of the bigger comprehensive immigration bill. We too need a change.
Below are some statistics and details of the problem, just in case you missed a point.
1. High technology H1-B visas allowed into US = 85,000 H1B per year.
2. H1B quota limit per country = None, quota limits.
3. Greencard eligible candidates = All H1B holders
4. Total Employment Greencards = 145,000 per year.
5. Quota limits for greencards = 7% per country and each family member is counted as 1 visa.
6. H1 holders from India = 30,000 to 40,000 per year.
7. Greencards available for India by quota limits = 2000 � 3000 per year.
8. People waiting in Queues = 37,000 � 38,000 per year.
9. Estimated wait = 10- 15 years per life.
10. Estimated loss of productivity = unlimited.
11. Loss of health and health related issues due to these worries = incalculable.
Consequences:
1. EB3 Employment based category from India is severely backlogged,
2. Number of applicants in Queues waiting to buy house = 300,000
3. Number of applicants in Queues buying a house now = 0.
4. Money spent by applicants on rent per year = $6 billion
5. Number of applicants having Citizen children born in US = 80%
6. Number of applicants unable to start own companies(as they are tied to employer all the time due to greencard sponsorship)
= 30-40%
7. Applicants disappointed and leaving US = 10-15%
8. Applicants planning to come back after retirement who take with them US Citizens who will sponsor them = everybody who is leaving US right now with Citizen kids
9. Burden on social security and healthcare by applicants in point 7 = billions of dollars.
10. Severe pain for everyone wasting time on worries and uncertainity.
11. Many people thinking of returning back, very disappointed.
Solution
Please provide immediate relief. We are still holding our bags in hands even after 5-10 years of playing it by law after applying for greencards. Please respect liberty and freedom and let that happen to legal applicants.
1. Please remove country quotas for greencards immediately to make waiting less for legal employer based EB2/EB3 applicants from India in long queues ALREADY in US for years.
2. This needs No new jobs or Visas. It�s just a simple fix to help bring joy to some legal immigrants and give them freedom to contribute more.
3. Please provide greencards for any legal employment based applicant who lived in US for atleast 5 years and is waiting for more than 5 years and paid taxes and live like a good American Citizen.
4. Please provide Citizenship for anyone who lived in US for 10 years and played by the rules all the time and paid taxes.
5. This will help people buy houses that are so cheap now which will pump in $40 billion even if 50% people buy houses.
6. Construction jobs increase as people start buying houses.
7. Manufacturing and auto industry improves as people start buying cars again due to renewed confidence. Else they continue to adjust with their old cars for now.
8. A fee of $1000-$3000 can be applied for premium processing which can generate $1.5 billion instantly.
9. Stop the distribution of 50000 diversity greencards lottery per year immediately. This is bad in the current times, when people are waiting in legal queues for ever.
10. Issue greencards immediately to anyone who did PhD in US and to Masters Students.. They will be more productive if you help here.
11. Please don�t wait for CIR to have these. This is a small admin fix, no new visas or jobs.

The established truth so far is
USCIS used all the numbers ahead of time and shut the door on highly skilled immigrants on day one
DOS revised its July 2007 visa bulletin on day one 1, which has not happened in a long time or never.
The wind mill stories are
Some law firms started hallucinating that the security checks were never done. They themselves do not know for sure. If you go and look towards the end of the blog post where it originated, he asks for confirmation instead of telling his resources.
