Dear IV members,
As of 23 September 2006, we have received less than 15 questions in preparation for the next call. This does not meet the critical mass of 20-25 questions for justifying a conference call.
Please follow process listed in the thread http://immigrationvoice.org/forum/showthread.php?t=1267 for us to consider your questions.
Also, please spread the word around.
I am attaching a flyer for your convenience. You could request your friendly neighborhood ethnic grocer (Indian/Mexican/Chinese/Filipino and others) or video rental store, religious gathering or communal gathering place to carry these flyers in a prominent location. (You'll be surprised at the positive response you will get from such businesses- I had my reservations at first, but when I approached a temple sometime back, the temple officer appreciated the efforts made by us for such a "great cause"- his own words).

My Husband's I 140 got approved and his lawyer included my name as well in the I 140 application.
Can some one plss help me by letting me know if I can change to F1 for my further studies inspite of my name being included in the I 140 application
Plss let me know at the earliest possible as I need to apply for change of status before may....!!!!!

I need an advice.
I was in US since Apr 1999. FIled for GC in oct 2000. I got my I-140 approved.But then i had to go back to india as my company transferred me to india office in Oct 2001.
I left that company in jan 2004 and joined another company in india. Then in July 2004 i came back to US thru a consulting firm. An din jan 2005 my client offered a job. So since Jan 2005 i am working at the cients office as their employee. I filed for LC in Sep 2005, it got approved in oct 2005 (Just mised by 3 weeks)
My question is was was it possible to use the PD from my previous GC. which is Oct 2000.My atternoy told me it is not possible. But i saw similer posting on IV, hence i am curious. Also if possible is there any way i can get the old GC at this stage,my I-140 is approved this time too.,

Hi All,
Can any one give me what is the usual time frame given to respond to an RFE for I 140. I have seen in various threads that it is usually 12 weeks.
On Feb 22nd, I got an RFE on my 140 and the letter reached attorney's office on Mar 6th. On the RFE letter, USCIS has asked to repsond by April 7th. That is hardly 6 weeks and 4 weeks from the data I recd the letter. Is this usual?

1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.

Well, if you have a job offer for which you qualify and all relevant supporting documents, I dont see why you wont get the approval.

I had an H1 for about 3 years (2 different employers), and then was hired by an international organization. I gave up the H1 and got a G4 visa, which I still have. Over the last 3 years with a G4, my credentials have changed, and am due to get my masters degree in May 2008. If I were to move to a job requiring H1 when I get my masters, will the total number of years allowed for me to hold an H1 roll back to 6 years? I'm thinking that since the skills I had as an H1B visa holder before have changed now.

I recently got my H1 3 yr extension based on I-140 approval, I want to change my job to company B but my employer Company A says that he will have to revoke the I-140(as per company attorneys), Will this affect my H1 extension(as in will I be out of status?) and can I retain my PD?
Also does anyone know a good lawyer I can consult over the phone?

Due to a sudden demise of my wife's grandmother, my wife had to go to India last week. She is planning to come back by Nov. 15. I received the receipt notices for my wife's I-485, I-131 and I-765. My question is if the fingerprinting notice comes before she arrives and also if it is scheduled prior to her arrival date on Nov. 14; what are the options of rescheduling and can we get the date of our choice after Nov. 14. Also, I would be extremely grateful, if someone could upload a sample fingerprinting notice from USCIS. I couldn't find any where on the site.

I initially voted in favour of this, but on further reflection, I think this is bad policy and urge others to not support this.
Giving I-485 benefits to people without current PDs is a bad idea. It creates a class of immigrants who are neither non-immigrant visa holders (h1b) nor are they lawful permanent residents (i-551) with a set of rights that falls into neither category. The AoS pending status is intended as a short-duration temporary "gap" coverage for people who are a matter of months from having actual I-551 rights.
Essentially, this proposal aims to make every month into the July 2007 fiasco. In addition, and this is the truly horrible part of it, relieves US employers of the pressure and costs they feel now, extending H1Bs every 3 years. That means that the only allies that legal EB immigrants have (US Employers who require their services) are detached from the immigrants themselves...they no longer have a dog in the hunt, and will stop whatever pressure they are bringing to bear now upon Congresscritters and Senators to increase the number of EB visas available.
Disconnecting the interests of foreign-national employees from their US employers will weaken the political position of the foreign-national employees. We cannot vote or contribute to campaigns, our employers however, can do both. If employees are shifted to EADs and APs, with no further involvement of employers in their immigration status needed, then those employers become disconnected from the process, and the one and only ally the legal immigrant has is no longer interested. That's a horrible thing for the immigrant to advocate.
I strongly urge IV to back away from this proposal, as it is not in the long-term interests of the EB Immigrant community. I urge IV to instead focus their resources on items that will help immigrants long term, like increasing the number of EB visas available through initiatives like eliminating the DV program and allocating the visas to EB applicants.

The wait time between filing I-485 and receiving the green card is already beyond the norm and a lot of companies are aware of this. Imagine the wait times for the people who haven't yet been able to file for their Adjustment of Status. Wouldn't it help them (and their dependents) if they are at least allowed to file for their AOS? I invite the members to provide their perspectives on the issues raised by JeffDG above. Please do not attack each other. Let us fight together in lieu of fighting each other..

I applied for my AP in June and recently at the end of August my AP was approved. I received the AP a couple of weeks later in mail. However I noticed that instead of receiving the I-512 Authorization of Parole of an Alien into the United States, I received an I-797C Notice of Action document for me an my wife. The contents of this I-797C are exactly the same as the previous I-512s that I have filed for and received over the years.
What I am afraid of is that this may cause problem at the port of entry when I return back from India because of the wrong title of the document.
Has anyone else received such a a document I-797C instead of I-512 and is it safe to travel having such a document? Any advice/input is appreciated.

I applied for extension of stay to California Sercice Center. But if I move to Texas, will be my case transfered to VSC??

if it is an extension of B2 status, I don't think your case will be transferred to a different center if you move to a different state. you just have to inform the service center regarding change of address(I think you can send a AR-11 form) this is just my personal opinion. please check with the lawyer who filed your extension or other experts
