    Hello All,



    I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .



    My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?

    I am an EB3 (rest of the world) -
    My I485 has a receipt date of 7/24/2007.
    The processing date TSC is showing is 7/16/2007.

    When my date comes up inside the Processing dates range, will the category be relevant for the approval? I am asking this question because I have a friend that is an EB2 and a receipt date of Sept 2007, and got his GC on December 2007...
    If the categories are relevant, how can we monitor the process (the processing dates then become irrelevant)...

    I have a question about forming an LLC while being on H1B. I am entering into an agreement with an Incorporated company to provide my technical services to it and in return they need to give me a percentage of the revenue. Clearly, I cannot enter into this kind of arrangement as myself as I not authorized to work in the US. For that I am planning to form an LLC or an Incorporation and my company will enter into a contract with the other Incorporation. Is this legal or will this be construed as an effort to bypass H1B laws? I'll still be doing the daytime job and fulfilling my obligations that I have with the H1B sponsoring employer.

    Please let me know your opinion.

    It can be done in Swift 3D. First, create a box. Then create a pyramid shape and place it above the box. Color the pyramid red and the box a white or brown. You now have a house.     Dear Experts,

    My wife's H1 is pending from H4. Its got selected in lottery and waiting for approval. But in the mean time we have to go to Canada and come back within 3 days. I would like to know if this impacts the COS. If it so, what are the options, means again can we apply for COS once we get the H1 approval without COS? Please let me know the options.

    Yes it is pretty much recognised for h1b purpose or for any other purpose whatsoever. I got my first h1b approval on the basis of my MBA from IGNOU.

    Online status says my applications were recd on Oct 2/ 2007.

    My reciept notices show the right date in August.

    Supposed my I-485 was approved, am I legally required to go to USCIS, surrender my I-94 card and get a I-551 stamp? Could I just wait for GC to come in the mail?

    The card is taking just a few days to arrive these days. Just wait for a few more days. You need the I-485 approval notice to get I-551 stamp.
    But I'm sure you won't need it.

    Hello All,

    I am new to this forum and this is my first post. I am not sure if I can even bring this topic up about PERM in this forum. So, if this is irrelavant, please let me know.

    My employer will be submitting a PERM application for my L.C. in a day or two. All the requirements for the job are complete. My question is, on the applciation there is question (Q:12) which states about "business necessity" and my employe will be checking "NO" as the answer. I am not sure what impication this could have on my application. The job requirement is B.S. degree with 5 yrs experience. I have a M.S. degree with 5 Yrs experience.

    Please let me know if we are going in the right direction.

    Hi! My company is moving to another address. My I-140 was filed on July 2, 2007 (USCIS receipt date August 20, 2007). My H-1B 6th year will end on July 1, 2009. My lawyer wants to file for the change of address and the H-1B extension together. He is asking for about $2k+ for self and family (incl atty fee and filing fees).

    Is the change of address on H-1B that big a deal? Can anyone please advise? Is it not a simple AR-11 form that has to be filed? Are the requirements for change of address different once labor certification is done.

    My agent says interest earned over the period is taxfree in otherwords, the maturity amount is all taxfree
